PHILADELPHIA –– The 3rd Circuit has denied a petition for writ of mandamus filed by the Official Committee of Talc Claimants, saying that the writ of mandamus “is a drastic and extraordinary remedy.”

The 3rd Circuit U.S. Court of Appeals issued an order on May 9 denying the petition, opining that “there are other adequate means for the petitioner to obtain the relief it seeks” and that its denial of the petition would allow the Chapter 11 proceedings of LTL Management to continue on the “expedited basis set by the Bankruptcy Court for the District of New Jersey.”
