Missouri Appellate Court Tosses $72 Million Talcum Powder Verdict, Says Court Didn’t Have Jurisdiction

ST.LOUIS - A Missouri appellate court has tossed a $72 million talcum powder verdict, finding that the trial court did not have jurisdiction over the claims in light of a recent U.S. Supreme Court decision.

In an Oct. 17 opinion, The Missouri Court of Appeals, Eastern District, held that the plaintiff had “provide[d] no Missouri precedent illuminating a procedural path for this court to stay a jury verdict pending re-litigation of facts supporting jurisdiction. Simply put, this court declines to remand the case in its advanced posture.”
