Pa. Federal Judge Remands Minor League Baseball Team’s COVID-19 Coverage Action

HARRISBURG — A Pennsylvania federal judge has remanded a COVID-19 business interruption coverage action filed by the owner of the New York Yankees’ minor league baseball team, ruling that the complaint sets forth viable claims against non-diverse defendant Continental Insurance Co. (CIC).

In an Oct. 1 order, Judge John E. Jones of the U.S. District Court for the Middle District of Pennsylvania found no basis for concluding that SWB Yankees LLC’s claims against CIC, CNA Financial Corp. and Continental Casualty Co. for concluding that all three of Plaintiff’s claims against Defendant CIC are “wholly insubstantial and frivolous.”
