Calif. Plaintiffs Fight Lumber Liquidators Bid to Dismiss Case Based on Inadequate ‘Deconstructive’ Testing

SAN FRANCISCO — Testing used to determine that Lumber Liquidators laminate wood flooring contains excess levels of formaldehyde employed a methodology required by California regulators and cannot be challenged based on speculation that testing standards may change in the future, plaintiffs argued in a brief filed recently in federal court.

Plaintiffs offered the argument in a March 25 response to Lumber Liquidators’ motion to dismiss class action claims accusing the company of representing that its flooring met state formaldehyde emission standards when at least three certified laboratories have confirmed that the product fails to comply.
