Union Pacific Seeks Summary Judgment in Dispute Over Reinsurance for Mine Subsidence Claims

SPRINGFIELD, Ill. — Union Pacific Railroad Co. has moved for summary in a dispute over whether a reinsurance fund can relitigate issues resolved in previous cases in which it sought reimbursement from the railroad for mine subsidence claims, arguing that the reinsurer is barred from doing so by claim preclusion.

In a Nov. 4 motion filed before Judge Sue Myerscough of the U.S. District Court for the Central District of Illinois, Union Pacific argues that the Illinois Mine Subsidence Insurance Fund (IMSIF) cannot relitigate because all elements of claim preclusion have been met.
