Policyholder Seeks Reinsurance Documents, Communications in Pollution Coverage Dispute

PADUCHA, Ky. — The policyholder in a pollution coverage action has asked a Kentucky federal judge to compel the defendant insurer and reinsurer to produce claims manuals and guidelines, and reinsurance documents and communications, arguing that they are relevant to the dispute.

In a Sept. 13 motion filed before Judge Claria H. Boom of the U.S. District Court for the Western District of Kentucky, CC Metals and Alloys LLC (CCMA) also seeks to compel the inspection of certain non-privileged documents and communications from defendants’ privilege and redaction logs and/or compel defendants’ production of such documents and communications.
