PGIC Says SPARTA Must Produce Third-Party Communications in Reinsurance Dispute

BOSTON — Pennsylvania Insurance Co. (PGIC) has asked a Pennsylvania federal judge to compel SPARTA Insurance Co. to produce 130 documents containing communications involving third parties in a dispute over payment of claims relating to a stock purchase agreement and reinsurance contract.
In a Jan. 22 brief filed before Chief Judge F. Dennis Saylor of the U.S. District Court for the District of Massachusetts, PGIC argues that the documents are not subject to the common interest doctrine, which extends the attorney-client privilege to certain communications involving third parties that the privilege otherwise would not protect.
