DETROIT — Amerisure Mutual Insurance Co. is urging a Michigan federal judge to deny Transatlantic Reinsurance Co.’s motion to amend an affirmative defense alleging Amerisure failed to disclose material information during the underwriting of certain reinsurance certificates.

In a June 16 opposition filed before Judge Stephen J. Murphy III of the U.S. District Court for the Eastern District of Michigan, Amerisure says TransRe has adopted a “kitchen sink” defense strategy, asserting baseless and constantly shifting “affirmative” and other defenses in response to Amerisure’s claims — an approach that violates TransRe’s own duty of utmost good faith.
