Dentist, Brewery Sue Insurer for COVID-19 Losses in Mass. Federal Court

BOSTON — A New Jersey dentist has teamed up with a Boston-area brewery to sue Ohio Security Insurance Co. for coverage of business income losses they sustained when they were forced to close in compliance with government COVID-19 orders.

In a class action complaint filed Nov. 6 in the U.S. District Court for the District of Massachusetts, Dominick A. Lembo Belmont Dental Associates PC and Mercury Brewing and Distribution Company Inc. contend that as a result of the forced closures, they sustained “direct physical loss” or “damage to property,” as required by the policies.
