OMAHA, Neb. — A Nebraska court lacks personal jurisdiction over a New York company named as a defendant in a dispute over an Applied Underwriters reinsurance participation agreement (RPA), a state appellate court has ruled.
In a Nov. 12 opinion, the Nebraska Court of Appeals noted that Applied Underwriters Captive Risk Assurance Company Inc. (AUCRA) did not appeal that part of the trial court’s determination that jurisdiction is lacking under Neb. Rev. Stat. § 25-538. Therefore, the ruling must stand, the appellate court held.
