HARTFORD, Conn. — An arbitration panel should decide the threshold issue of whether a reinsurance dispute should be arbitrated or determined by an actuary panel, a Connecticut federal judge has ruled, holding that the parties’ arbitration agreement encompasses the question.

In an Aug. 18 order, Senior Judge Warren W. Eginton of the U.S. District Court for the District of Connecticut further ruled that Travelers Indemnity Co. has not waived its right to submit a list of candidates for its party arbitrator.
