PHOENIX — The defendant in a securities fraud action waived her right to seek vacatur or modification of an arbitration award because she failed to file her objections within three months after the award had been filed or delivered, an Arizona federal judge has ruled.

In a Jan. 20 order, Judge G. Murray Snow of the U.S. District Court for the District of Arizona found the plaintiff failed to provide evidence that she had not received notice of the award, therefore the defenses in the Federal Arbitration Act are not available to her.
