AIG Companies Seek Injunction Barring Transamerica, Fair American From Forcing them to Arbitrate Reinsurance Claims

NEW YORK — Various American Insurance Group companies have asked a New York state court to enjoin Transatlantic Reinsurance Co. and Fair American Insurance and Reinsurance Co. from forcing them to proceed with the arbitration of reinsurance claims arising from two sets of reinsurance contracts.
In a March 13 complaint filed in the New York County Supreme Court, the AIG insurers assert that TRC’s arbitration demands are defective because not all of them are parties to the contracts at issue. They further argue that the demands seek to initiate arbitration under agreements that are already the subject of ongoing arbitrations …
