Plaintiffs in Mortgage Reinsurance Case Adequately Pled Entitlement to Equitable Tolling, Pa. Federal Judge Rules

PITTSBURGH, Pa. — A Pennsylvania federal judge has refused to dismiss a class action accusing Citibank and its captive reinsurers of engaging in a mortgage reinsurance kickback scheme, finding the plaintiffs have adequately pled an entitlement to equitable tolling.

On Feb. 5, Judge Mark R. Hornak of the U.S. District Court for the Western District of Pennsylvania noted the second amended complaint explains how and when plaintiffs learned about the possibility of their claims, what they did in response, and why they could not have pursued their claims within the Real Estate Settlement Practices Act’s one-year statute of limitations.
