Pa. Federal Judge Denies M&T’s Request to Stay Discovery in Mortgage Reinsurance Case

SCRANTON, Pa. — A Pennsylvania federal judge has denied M&T Bank and M&T Reinsurance Co.’s motion to stay discovery in a suit accusing them of violating the Real Estate Settlement Procedures Act by engaging in a mortgage reinsurance scheme.

On Jan. 14, Chief Judge Christopher C. Conner of the U.S. District Court for the Middle District of Pennsylvania found that a stay of discovery pending an appeal to the 3rd Circuit in a similar case is not warranted, because it is not certain that the record to be developed here will be identical to the record before the appellate court.
