Conn. Federal Judge Denies Excalibur’s Motion to Strike Affidavit of Travelers Employee

HARTFORD, Conn. – A Connecticut federal judge has denied Excalibur Reinsurance Corp.’s motion to strike an affidavit submitted by Travelers Insurance Co. in support of its new claim that Excalibur violated the Connecticut Unfair Trade Practices Act by waiting 210 days to review reinsurance claims.

In an Aug. 5 order, Senior Judge Charles Haight Jr. of the U.S. District Court for the District of Connecticut found Excalibur will not be prejudiced by the affidavit because it has the chance to respond. The judge also allowed Excalibur to file a declaration to rebut statements made in the affidavit.
