AIU Objects to Magistrate’s Findings in TIG Reinsurance Case

NEW YORK — AIU Insurance Co. has objected to a federal magistrate judge’s recommendation that TIG Insurance Co. be granted summary judgment on its claim that AIU’s failure to provide timely notice of its settlement of asbestos claims relieves TIG of liability under certain facultative certificates.

In its Sept. 18 objection, AIU asserts that Magistrate Judge Henry Pitman of the U.S. District Court for the Southern District of New York erred in applying Illinois law to the dispute and did not carefully predict whether the Illinois Supreme Court would require TIG to show it was prejudiced by the untimely notice.
