SAN FRANCISCO - A California federal judge has compelled arbitration of an employment class action, ruling that the plaintiffs failed to meet their burden of proving that the defendants waived their right to arbitrate. Morse v. ServiceMaster Global Holdings Inc., No. C 10-00628 (N.D. Calif.).

On July 27, Judge Susan Illston of the U.S. District Court for the Northern District of California found that plaintiffs' waiver arguments are based upon actions taken by defendants before the Supreme Court issued its decision in AT&T Mobility LLC v. Concepcion (131 S.Ct. 1740 [2011]).
