MGA Breached Territorial Limitations in Agreement, Texas Court Affirms

WACO, Texas - A managing general agent breached the territorial limitations in a general management agreement, entitling Apex Lloyds Insurance Co. to damages for breach of contract, a Texas appellate court has affirmed. Texas All Risk General Agency Inc., et al., v. Apex Lloyds Insurance Co., No. 10-10-17 (Texas Ct. App., Waco Div.).
The Texas Court of Appeal, Waco Division, ruled that the contract clearly required Texas All Risk General Agency Inc. (TAR) "not to write more than 10 percent of its policies in Harris County, Texas." TAR breached the contract by exceeding that amount, the court affirmed.
