Parties In Madison County, Ill., Await Forum Ruling in Benzene Case

EDWARDSVILLE, Ill. -- An Illinois trial court judge is poised to make a determination on a forum non conveniens motion to dismiss in a benzene case that defendants argue has no ties to the county in which it was filed. Leek, et al. v. Betz Dearborn, et al., No. 04-L-1232 (Ill. 3rd Jud. Cir. Ct., Madison Cty.).

The plaintiffs have filed an opposition, however, stating that the motion pending before Judge Barbara Crowder of the Third Judicial Circuit Court for Madison County attempts to "recast" the factors required to issue such an order.
