Court Denies Plaintiff Efforts to Appeal Dismissal Grounded in Parker

ROCHESTER, N.Y. -- A New York appellate court has denied a plaintiff's application seeking permission to appeal a decision dismissing his case for the failure to produce medical or scientific literature to support claims that his aplastic anemia was caused by benzene exposure. Nawrocki v. The Coastal Corp., et al., No. CA 06-02187 (N.Y. Sup. Ct., App. Div., 4th Jud. Dept.).

In a two-page order entered Feb. 1, the New York Fourth Judicial Department of the Appellate Division denied the application without further comment.
