OAKLAND, Calif. -- A California court has found that defendants did not violate a stay order when they asserted a statute of limitations defense in a case that was re-filed in Texas. Morris v. AGFA Corp., et al., No. RG04182737 (Calif. Super. Ct., Alameda Cty.); Loftin, et al. v. E.I. Dupont De Nemours and Company, et al., No. A070037 (Texas 128th Jud. Dist. Ct., Orange Cty.).
