N.J. Court Upholds Summary Judgment Awards to Supplier Defendants

NEWARK, N.J. -- A New Jersey appellate court has upheld summary judgment awards to three benzene defendants on failure-to-warn claims, after determining that the chemical compositions they sold to other manufacturers did not contain impermissible amounts of benzene. D'Apuzzo, et al. v. Union Camp Corp., et al., No. A-1950-05T2 (N.J. Super. Ct., App. Div.).
In the July 31 opinion, the Appellate Division of the Superior Court of New Jersey agreed with a lower court's finding that the supplier defendants properly disclosed all ingredients in the hexane and naphthol spirits that were later included in printing cleaning products.
