WILMINGTON, Del. -- The Delaware judge overseeing the coordinated benzene docket has issued a ruling further clarifying specifications regarding pleading requirements for the lawsuits. In re: Benzene Litigation; Hamill, No. 05C-09-020; Heddinger, No. 06C-05-295 (Del. Super. Ct., New Castle Cty.).
The Feb. 26 opinion by the Delaware Superior Court for New Castle County denied three motions to dismiss two benzene lawsuits on pleading grounds, but granted a fourth motion to dismiss with leave to amend.
