Court Says Plaintiffs Cannot Seek Data from Unpublished Study

HOUSTON -- A Texas Appellate Court has granted a petition for writ of mandamus, finding that interrogatories served on two benzene defendants were overly broad because they did not specify time, place or subject matter. In Re: BP Amoco Chemical Co. and BP Products North America, No. 14-06-00778 CV (Texas 14th Ct. App.).

In the Jan. 25 opinion, the Texas 14th Court of Appeals also opined that the plaintiff could not seek data relating to an unpublished epidemiological study, in part because he did not show that he could qualify as a member of those study groups.
