MONTGOMERY, Ala. -- A benzene plaintiff whose attempts to challenge Alabama's two-year statute of limitations were recently denied by the Alabama Supreme Court plans on filing a petition for writ of certiorari in the U.S. Supreme Court, his counsel told HarrisMartin. Cline v. Ashland Inc., et al., No. 1041076 (Ala. Sup. Ct.).
Robert L. Palmer, an attorney with the Environmental Litigation Group in Birmingham, Ala., and counsel to plaintiff Jack Cline, told HarrisMartin that Cline is planning on seeking relief from the nation's highest court on grounds that he was denied due process.
