Del. Judge Oversees 2nd Hearing on Motions to Dismiss




WILMINGTON, Del. -- On Oct. 26, the judge overseeing the Delaware coordinated benzene docket presided over another hearing on motions to dismiss for failure to plead with particularity, sources told HarrisMartin. In re: Benzene Litigation, No. C.A. No., 05C-09-191 BEN (Del. Super. Ct., New Castle Cty.).

This is the second time such a motion has been brought before Judge Joseph R. Slights III of the Delaware Superior Court for New Castle County. In April, Judge Slights dismissed several of the lawsuits but allowed plaintiffs 90 days to re-file. Sources said that several defendants re-filed the motion, reasserting their argument that …
