LOS ANGELES -- A California man was permitted by a federal judge to file an amended complaint, in which he alleges that Pepsico failed to disclose information about its Pepsi Twist product's benzene levels. Jolly, et al. v. Pepsico, et al., No. 06-0802 (S.D. Calif.).

Judge Barry T. Moskowitz of the U.S. District Court for the Southern District of California denied a Pepsico motion to dismiss on Aug. 28, allowing the plaintiffs to file the amended complaint and giving Pepsico 30 days from the date of service to reassert the dismissal motion.
