ST. LOUIS -- A Missouri federal court has denied a motion to strike the affidavits of two of the plaintiff's former co-workers without prejudice, noting that although the defendants have "raised serious concerns in support of their motion," the plaintiffs have indicated the use of the testimony in question may not even be necessary. Whitehead v. Baxter Healthcare Corp., et al., No. 08-0421 (E.D. Mo.).

In the Oct. 22 order, the U.S. District Court for the Eastern District of Missouri said that should the plaintiffs attempt to use the testimony of the two witnesses in question, the defendants may re-file …
