WILMINGTON, Del. -- Plaintiffs have voluntarily dismissed seven defendants in one of the lead trial cases in the coordinated Delaware benzene docket, leaving only Radiator Specialty and U.S. Steel left in the complaint. Diorio, et al. v. A.H. Wirz, et al., No. 05C-06-319 BEN; In re: Benzene Litigation, No. C.A. No., 05C-09-191 BEN (Del. Super. Ct., New Castle Cty.).
The Dec. 7 notices entered in the Delaware Superior Court for New Castle County did not give a reason for the dismissals, but the separate orders stipulate that the dismissals are without prejudice.
