Court to Oversee Motion to Dismiss Benzene Action on Failure to Comply Grounds

JACKSON, Miss. -- The Mississippi Circuit Court for Choctaw County is scheduled to oversee arguments relating to a defense motion to dismiss a benzene action on July 24, sources told HarrisMartin. Simmons, et al. v. First Chemical Corp., et al., No. 2004-0036 (Miss. Cir. Ct., Choctaw Cty.).

The June 5 motion to dismiss says that the court ordered the plaintiffs to file an amended complaint detailing specific information relating to the details of the plaintiffs' alleged injuries. While the plaintiffs complied with that order, they failed to detail the required information, the defendants say.
