Hearing Set on Motion to Dismiss 'Vague and Ambiguous' Complaint

MERIDIAN, Miss. -- A May 16 hearing has been set in the Mississippi Circuit Court for Clarke County to address a motion to dismiss a benzene action for failure to plead specific facts. Davis v. Amerada Hess, et al., No. 2004-140R (Miss. Cir. Ct., Clarke Cty.).
Defendant Pruet Production Co. has moved to dismiss the lawsuit of Angela Davis, who claims her acute myelogenous leukemia was caused by exposure to benzene.
Davis' claims were severed from the action Smith, et al. v. Amerada Hess, et al., in November, and the plaintiff filed her second amended complaint in December.
