Proposed Alabama Legislation Tackles Statute of Limitations in Tort Claims




MONTGOMERY, Ala. - An Alabama senator has introduced legislation that would change statute of limitations laws, which currently allow claimants to file suit within two years of their last exposure to an alleged toxin.

The measure was introduced March 9 by Sen. Henry Sanders (D), who represents the 23rd District of Alabama.

Under current Alabama law, plaintiffs must file their lawsuits two years after the date of their last exposure. A synopsis of the proposed bill states that it "would provide that a civil action for exposure to toxic substances shall be deemed to accrue from the date the …
