NEW YORK -- The U.S. District Court for the Eastern District of New York has awarded summary judgment to a distributor of a benzene-containing product, finding that warnings do not need to be displayed on the product's principal display panel to satisfy Federal Hazardous Substances Act provisions. Richards v. Home Depot Inc., No. 04-2025 (E.D. N.Y.).
Plaintiff Curize Olanda Maria Richards filed a notice of appeal to the U.S. Court of Appeals for the Second Circuit on Sept. 29.
