Monsanto Files Brief Supporting Position that Unsettled Roundup Bellwether Case is Time-Barred

SAN FRANCISCO –– Monsanto has filed a response brief with the court overseeing the national multidistrict litigation docket for Roundup personal injury claims, maintaining its position that an unsettled bellwether case is time-barred.

In the Nov. 17 response filed in the U.S. District Court for the Northern District of California, Monsanto noted that no new cases had been decided since a Feb. 2019 summary judgment hearing that “would warrant excusing Mr. Gebeyehou’s untimely filed complaint.”

And, the defendant argued, California law is “clear” in that negligence by Gebeyehou, or his attorney, does not excuse the failure to file the complaint …
