Monsanto Co. Moves to Dismiss Roundup Suit, Says Claims Fail under LPLA, are Time-Barred

NEW ORLEANS –– Monsanto Company has moved to dismiss a Roundup exposure suit pending in Louisiana federal court, arguing in part that all of the claims fail under the Louisiana Products Liability Act.

In the July 11 motion filed in the U.S. District Court for the Eastern District of Louisiana, Monsanto also maintained that the claims are precluded by the state’s one-year prescriptive period and that punitive damages are barred under Louisiana law.

In his complaint, plaintiff James Work said that, during his employment as a lawn care professional, he used Roundup on “hundreds” of properties.
