Benzene Plaintiffs File Motion to Compel, Seek Access to Privilege Logs

BOSTON ¬–– Plaintiffs with benzene-related claims pending in Massachusetts federal court have moved to compel Berryman Products Inc. to produce privilege logs and identify information related to depositions.

In the Jan. 11 motion filed in the U.S. District Court for the District of Massachusetts, the plaintiffs also pointed out Berryman has contradicted itself by claiming that it has not withheld any documents.

“Berryman cannot both rely on these documents to support its discovery responses, claim they are all purportedly confidential, and then indicate no such documents exist,” the motion stated.
