Defendants Named in Iowa Benzene Case Move to Dismiss Again, Cite Pleading Deficiencies

DAVENPORT, Iowa –– Defendants named in an Iowa benzene case have again moved to dismiss the claims, saying that the plaintiffs’ claims are not only untimely, but have not been re-plead with the requisite specificity required by the federal court in a prior order.

In an August motion filed in the U.S. District Court for the Southern District of Iowa, defendants CF Industries Holdings Inc. and CF Industries Sales LLC maintained that the plaintiffs’ claims were also identical to her second amended pleading, which the court found insufficient.
