NEW ORLEANS –– Benzene defendants have opposed a motion to exclude air monitoring results, saying that the data reports proffered by the third-party company are “admissible business records,” and are not secondary evidence.

In the Aug. 21 brief filed in the U.S. District Court for the Eastern District of Louisiana, defendants ExxonMobil Corp. and Chalmette Refining LLC opposed the plaintiffs’ motion to exclude air monitoring evidence, saying that the data reports are admissible business records and, further that they were made near the time of the monitoring.
