DETROIT –– Plaintiffs asserting benzene claims that were thrown out by a federal court in August have filed a notice of appeal with the U.S. Court of Appeals for the 6th Circuit, according to recent documents.

The notice of appeal was filed by the plaintiffs on Sept. 3 in the U.S. District Court for the Eastern District of Michigan, which determined in its ruling that the case should be dismissed in light of prior findings that the plaintiffs’ expert testimony was inadmissible.
