MILWAUKEE –– A paint defendant in an ongoing benzene trial has moved for a judgment as a matter of law, saying that testimony offered by plaintiff experts is inadmissible and, without it, the plaintiff cannot sustain her burden of proof as to strict liability and negligence claims.

In a March 10 motion filed in the U.S. District Court for the Eastern District of Wisconsin, Akzo Nobel Paints LLC argued that the jury “cannot possibly rely on” the plaintiffs’ expert testimony since the experts “are unable to state to a reasonable degree of scientific certainty” that the plaintiff’s injury was caused …
