Wisconsin Court Refuses to Strike Exhibits Filed by Benzene Plaintiffs in Anticipation of Trial

MILWAUKEE –– A Wisconsin federal court has denied a defense motion to strike an amended trial exhibit list submitted by the plaintiffs, ruling that when the trial was rescheduled, both parties “were entitled to file a new pretrial report.”

In the March 3 order, the U.S. District Court for the Eastern District of Wisconsin found that the plaintiff was not beholden to the trial report that was previously filed.

The claims were brought on behalf of Donald Schultz. Schultz’s work as a painter for American Motors Corp., now known as Chrysler, required him to work with benzene-containing paint products, including …
