Michigan Benzene Plaintiffs Oppose Recent Efforts by Safety-Kleen to Revisit Summary Judgment Motion

DETROIT –– Plaintiffs in a Michigan benzene case have opposed a motion by Safety-Kleen for summary judgment, saying that the defendant “merely present[s] the same exact issues on which it previously lost.”

In their Dec. 1 response brief, filed in the U.S. District Court for the Eastern District of Michigan, the plaintiffs further argued that the defendant’s latest efforts are procedurally flawed.

The lawsuit was filed on behalf of Howard G. Hendrian, who was allegedly exposed to benzene-containing products while employed at Ford Motor Co. During the course of his employment, Hendrian cleaned automatic transmission valve bodies with 105 …
