The Pep Boys Move to Enforce Settlement Agreement in Benzene Case

PHILADELPHIA –– The Pep Boys –– Manny, Moe & Jack have moved to enforce a settlement agreement that was reached in a benzene case one year ago, arguing that the plaintiffs have failed to execute a joint tortfeasor release.

In a motion filed Nov. 20 in the Pennsylvania Court of Common Pleas for Philadelphia County, the defendant said that while it submitted a draft joint tortfeasor release to the plaintiff’s counsel for review, it was never executed.
