Puerto Rican Benzene Plaintiffs Back Briefs Filed with Court, Oppose Defense Efforts to Strike Evidence

SAN JUAN, Puerto Rico –– Benzene plaintiffs in a Puerto Rico case have opposed efforts by Safety-Kleen Systems Inc. to strike evidence the plaintiffs used to both refute and support pending in limine motions, contending in part that they are permitted to reference past testimony and state warnings.

In one of the two Aug. 11 briefs filed with the U.S. District Court for the District of Puerto Rico, the plaintiffs maintained that the evidence they used to support a motion to strike the testimony of a defense expert was admissible and allowed by the Federal Rules of Evidence.
