Defendants Move to Dismiss Pa. Benzene Case, Say Statute of Limitations Bars Claims

PHILADELPHIA –– Defendants named in a wrongful death lawsuit stemming from a newspaper pressman’s exposure to benzene have filed a motion for summary judgment, arguing the claims are barred by Pennsylvania’s two-year statute of limitations.

In a March 5 motion filed in the Pennsylvania Court of Common Pleas for Philadelphia County, one of the defendants says that the decedent’s widow personally observed her husband’s work with chemicals and, therefore, should have been aware of the cause of his injury at the time it was diagnosed.
