KANSAS CITY, Mo. –– Plaintiffs in a benzene case have filed a notice indicating their intent to appeal the dismissal of claims against Harley-Davidson (NYSE:HOG), taking advantage of the District Court’s decision to make its recent decision final and appealable immediately.

The notice of appeal was filed Jan. 29 in the U.S. District Court for the Western District of Missouri, which last month reversed its earlier position that collateral estoppel did not bar the claims and instead concluded that there is a difference between a decision that was incorrect when it was made and a decision that was correct …
