Mich. Court Excludes Portion of Kopstein Testimony in Benzene Case; Says Methodology ‘Flawed’

DETROIT –– A Michigan federal court has granted in part a motion to exclude the testimony of Melvyn Kopstein, Ph.D., in a benzene case, prohibiting the plaintiff expert witness from testifying on the benzene content of Safety-Kleen’s 105 Solvent and on the decedent’s inhalation exposures to that product.
In the Jan. 17 order, however, the U.S. District Court for the Eastern District of Michigan denied efforts to preclude testimony in other areas on which Kopstein is slated to testify, including the adequacy of warnings relating to the 105 Solvent.
