Puerto Rico Court Clarifies Cut-off Dates for Deposing Experts in Benzene Case

SAN JUAN, Puerto Rico –– A Puerto Rican federal court has issued an order saying that depositions of experts in a benzene case may occur any time prior to discovery cutoff deadlines in response to a recent defense emergency motion requesting clarification on an upcoming cut-off date.

On Jan. 15, Safety-Kleen Systems Inc. and Makita USA Inc. asked the U.S. District Court for the District of Puerto Rico to relieve the parties of the stipulated deadlines to depose experts and allow expert depositions to occur “at any time prior to the discovery deadline.”
