Texaco Downstream Properties Moves to Exclude Plaintiff Expert Testimony in Benzene Suit

NEW ORLEANS –– Texaco Downstream Properties Inc., the lone remaining defendant in a Louisiana benzene action, has moved to exclude the testimony of a number of benzene plaintiff’s experts, including Drs. Mark Nicas, Melvyn Kopstein, Jack Saux, and Peter Infante.

The defendant filed the Jan. 7 motions in the U.S. District Court for the Eastern District of Louisiana in conjunction with several other motions for summary judgment on issues relating to medical causation and the plaintiffs’ claims for negligence and for insurance coverage.
